Nurse fined $25k for working with COVID-19 at Melbourne aged care home

A nurse has been fined $25,000 for working at an aged care home in Melbourne while COVID-19 positive.
Kamaljeet Kaur Brar, 36, pleaded guilty in Moorabbin Magistrates Court on Wednesday to a single charge of failing to take reasonable care for the health and safety of persons at the workplace.
On July 26 and 27, 2020, she reported for casual work shifts at the Menarock Aged Care Services’ Rosehill in Highett, in Melbourne’s southeast, after a doctor advised her not to attend work and referred her for a COVID-19 test.

While completing a mandatory staff declaration log, she stated she did not have any COVID-19 symptoms on both occasions.
On July 30 2020, she tested positive for COVID-19 and two days later a resident at the home also tested positive for the virus.
The resident was sent to hospital while other residents were isolated to their rooms, and all staff were directed to wear full PPE.
The following day, the nurse turned up for an evening shift.

WorkSafe executive director of health and safety Narelle Beer said the nurse clearly breached occupational health and safety standards and put others at risk.
“Every worker in Victoria has a duty to ensure their actions do not put the health and safety of others in their workplace at risk,” Beer said.
“This includes cooperating with their employer’s efforts to control health and safety risks by following any instructions, policies and procedures and using supplied protective equipment.”
